January 22nd marks the anniversary of the Roe v Wade decision which legalized abortion in the United States. January 28, 1988 marks the anniversary of the “Morgentaler Decision” in Canada. The Supreme Court of Canada struck down the abortion law (then section 251 of the Criminal Code). The Supreme Court did not resolve the abortion issue and left it to PARLIAMENT to come up with a new law. Subsequent Prime Ministers have not opened the abortion debate since 1988.
It is worth noting that the Supreme Court of Canada did NOT decide on the following two questions:
- Whether a woman has a Charter right to abortion
- Whether the fetus (Latin word for offspring)/unborn child is included in the term “everyone” in the Charter of Rights and Freedoms and therefore has an independent right to “life, liberty and security of person” under section 7 of the Charter
